As a result, environmental claims have flooded the market\u2014from \u201ceco-friendly packaging\u201d to \u201ccarbon-neutral\u201d services. However, when these claims are not substantiated, we enter the zone of Greenwashing\u2014and that\u2019s where the Law steps in.<br>In countries across the region, the Consumer Protection Act (CPA) is the main legal instrument used to sanction such practices, treating them as misleading business conduct. Greenwashing, therefore, is not just an ethical failure\u2014it\u2019s a direct violation of the law.<\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-3ba0001\" data-block-id=\"3ba0001\"><style>.stk-3ba0001 .stk-block-text__text{font-size:16px !important;color:#000000d1 !important;}@media screen and (max-width: 1023px){.stk-3ba0001 .stk-block-text__text{font-size:16px !important;}}<\/style><p class=\"stk-block-text__text has-text-color has-text-align-justify-mobile\"><strong>What are the three most significant risks companies in the region face under the scrutiny of the CPA?<\/strong><\/p><\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-3d2035c\" data-block-id=\"3d2035c\"><style>.stk-3d2035c {margin-bottom:nullpx !important;}.stk-3d2035c .stk-block-text__text{font-size:16px !important;color:#000000d1 !important;}@media screen and (max-width: 1023px){.stk-3d2035c .stk-block-text__text{font-size:16px !important;}}<\/style><p class=\"stk-block-text__text has-text-color has-text-align-justify-mobile\">The Consumer Protection Act in the region (Serbia, Croatia, Bosnia and Herzegovina, Montenegro, etc.) clearly prohibits unfair business practices, particularly those that are misleading.<br>A business practice is considered misleading when a trader induces a consumer to make a purchasing decision they otherwise wouldn\u2019t have made\u2014by providing false or unverifiable information. This is the very definition of Greenwashing.<br>A company doesn\u2019t have to lie; it\u2019s enough to withhold essential information or use vague, generic terms without precise scientific backing.<\/p><\/div>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-stackable-text stk-block-text stk-block stk-4157cfc\" data-block-id=\"4157cfc\"><style>.stk-4157cfc .stk-block-text__text{font-size:16px !important;color:#000000d1 !important;}@media screen and (max-width: 1023px){.stk-4157cfc .stk-block-text__text{font-size:16px !important;}}<\/style><p class=\"stk-block-text__text has-text-color has-text-align-justify-mobile\">Three Key Risks for Companies in the Region<\/p><\/div>\n\n\n\n<ul class=\"custom-list\">\n\n  <li><b>Direct Financial Penalties<\/b><br> \nThis is the most obvious and immediate risk. The Market Inspectorate, as the main authority for enforcing the CPA, is authorized to initiate misdemeanor proceedings against companies engaged in misleading advertising.<br>\n<b>Penalty Amounts:<\/b> The laws impose significant fines, often ranging from several thousand to tens of thousands of euros (depending on the specific country\u2019s legislation and company size). In some cases, penalties are calculated as a percentage of annual turnover (as in the EU), making them especially painful for large corporations.<br>\n<b>Procedure:<\/b> Sanctions are imposed once it\u2019s determined that a claim (e.g., \u201c100% natural\u201d or \u201cclimate neutral\u201d) isn\u2019t backed by evidence (such as tests, certificates, or LCA analyses).<br>\n<b>Example:<\/b> A company claims its product is \u201cfully recyclable,\u201d but ignores the fact that local recycling infrastructure cannot process that type of packaging\u2014this constitutes a misleading claim punishable under the CPA.<\/li>\n\n  <li><b>Reputational Collapse and Loss of Consumer Trust<\/b><br>\nAlthough not directly regulated by the CPA, reputational risk often has far-reaching and costlier consequences than the financial penalty itself. In the age of social media, news about a Greenwashing fine spreads rapidly.<br>\n<b>\u201cCancel Culture\u201d:<\/b> Consumers\u2014especially younger generations\u2014are extremely sensitive to unethical business behavior. Public backlash and boycott campaigns can cost a company millions through reduced sales and long-term brand damage.<br>\n<b>Impact on B2B and Investors:<\/b> A reputation problem with consumers quickly extends to business partners (B2B) and investors. Loss of trust can make it harder to raise capital and may decrease share value.<\/li>\n\n  <li><b>Regulatory Measures and Mandatory Correction<\/b><br> \nIn addition to fines, a company is legally required under the Consumer Protection Act to immediately remove the misleading advertisement and, in some cases, publish a correction at its own expense.<br>\n<b>Correction Costs:<\/b> This includes expenses for withdrawing disputed marketing materials, redesigning packaging, and\u2014in extreme cases\u2014recalling products from the market. This creates significant operational pressure and additional financial burdens.<br>\n<b>Increased Oversight:<\/b> Once fined, a company becomes the target of increased scrutiny by inspection authorities.
